Floating Holidays.
As a part of the Public Employees Committee (PEC) negotiations this spring, Local 21 and most other city unions negotiated twelve (12) floating holidays to compensate for an employee give back of 4.62%. These floating holidays DO NOT include the four (4) prior floating holidays already in the Local 21 Agreement. For this year, our members have a total of sixteen (16) floating holidays.

Also as a part of negotiations under the PEC, we agreed to five (5) Minimum Staffing Days (MSDs). These days are mandatory closures of nonessential departments within the City that are scheduled for the day before Thanksgiving (November 24, 2010), and the four days between the observed Christmas and New Years Day holidays (December 27-30, 2010). These days require the use of five (5) of the floating holidays negotiated under the PEC. November 25-26, 2010, December 24, 2010, and December 31, 2010 are all paid holidays, as outlined in our MOU with the City.

We do have a concern that a department will grant more than the allotted floating holidays before they can be used as a MSD. We are currently working with the Employee Relations Department (ERD) to clarify this matter, should this occur. While we know our members carefully keep track of their time, we ask that closer attention be paid to the floating holidays so there are sufficient days to cover the Minimum Staffing Days.

All departments are being asked by the ERD office to submit a list of employees who will be required to work during the holidays, and we have also asked the ERD for a list of these members as these schedules are approved; however, they must submit a copy of City Departments to the Mayors office for approval first. The ERD must get us a copy of these departments by the beginning of August.

San Francisco Controller Ben Rosenfield Speaks
to Local 21 SF Council

In the midst of the holiday season, on December 16th the San Francisco Controller Ben Rosenfield impressed members of Local 21's SF Council with a straightforward and credible presentation of the Citys current budget projections for the next fiscal year. He was clear to emphasize that the projections are based on some very early and tentative figures. He also pointed to a rebound in pension fund investments and the hotel tax revenues as early signs of an emerging turn around - although he personally believes that the recovery will be slow and will take time.

San Francisco Retirement
San Francisco Board of Supervisor Sean Elsbernd and Mayor Gavin Newsom introduced a charter amendment at Tuesday's Board of Supervisor's meeting that would reshape the pension system. Several key unions, including Local 21, were called into the Mayor's office for individual briefings late last week, shortly before the amendments were introduced. A front page Chronicle story detailed the proposal and Local 21 received a copy of the full proposal later in the day.

"Reaction to the changes varies amongst different unions, but no one is happy with the manner in which this was sprung on people" said Local 21 Executive Director Bob Muscat.

Local 21 will begin an analysis of the proposal and make every effort to pull together a functional coalition of other city labor unions so that we can develop an informed and united response. If these changes get on the ballot in a manner objectionable to city employee unions, there will need to be a united effort to defeat the ballot measure. After the holidays, Local 21 will take a position in response to these proposals based on direction from our members and leaders. The average city pension is slightly over $2000 monthly - not enough to live in San Francisco and nothing to be defensive about.

Employee Relations Ordinance
The City has proposed a rewrite of the Employee Relations Ordinance (ERO). Along with the Charter and individual union collective bargaining agreements (CBAs), the ERO sets out various labor relations policies including bargaining units and recognition rights. The Citys stated purpose for their proposed rewrite is to update the ERO, reduce duplication and contradictions with the Charter and compliance with state law governing public employee relations.

The various labor organizations, including Local 21, have formed a Coalition to negotiate these changes with the City. After several lengthy meetings and a lot of hard work, the parties have moved close to a final agreement. Today, everyone seems pleased with our progress and the Citys flexibility in making changes in response to concerns raised by the Coalition.

It is worth noting that the Coalition includes all the major City unions, including SEIU, and the police and fire unions. It is a solid demonstration of labor cooperation and functionality.

The Union-City Partnership (UCP) is a joint partnership between Local 21 and the City and County of San Francisco. The Partnership s purpose is to create highly effective local government that is responsive to the fiscal realities of increasing service expectations and shrinking revenue.
